The Elder Justice Act (the \u201cAct\u201d) requires healthcare providers to provide an annual notice to its vendors of their obligation to report reasonable suspicion of a crime against a resident of a healthcare facility. One who fails to report is subject to civil penalties of up to $300,000 and exclusion from participation in any federal healthcare program.<\/p>

A report of reasonable suspicion of a crime against a resident must be made to the Indiana State Department of Health (ISDH) and local law enforcement. If the suspected crime involves bodily injury, the report should be made within two hours of the incident. If the suspected crime does not involve bodily injury, the report should be made within 24 hours after forming the suspicion. Such potential incidents can and should be reported to American Senior Communities\u2019 toll free Compliance Hotline at 1-888-788-2502<\/a>.<\/p>

Healthcare providers may not retaliate against anyone who lawfully reports the reasonable suspicion of a crime against a resident, as provided in the Act.<\/p>

Anyone who has lawfully made such a report and believes that they have become the subject of retaliatory action may file a complaint with the ISDH. To file a complaint regarding retaliation, the reporting party may call the ISDH Complaint Hotline at 1-800-246-8909<\/a>, or email the complaint to complaints@isdh.in.gov<\/a>.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

All business operations must be conducted in accordance with the highest ethical standards, state and federal healthcare requirements, and Company policy. The Company\u2019s compliance program helps to ensure that the Company complies with applicable laws and regulations and operates with honesty and integrity.\u00a0<\/span><\/p>

The Vendor Code of Conduct (Code) applies to all vendors and contractors, and compliance with the Code is expected of all vendors and contractors who do business with the Company.<\/span><\/p>

Compliance with Laws<\/span><\/span><\/p>

Vendors and contractors are required to conduct their business activities in compliance with applicable laws and regulations.<\/span><\/p>

Gifts and Gratuities<\/span><\/span><\/p>

Vendors acknowledge that the Company\u2019s employees are prohibited from accepting anything more than infrequent gifts which are of nominal value, including meals and entertainment.\u00a0<\/span><\/p>

Conflicts of Interest<\/span><\/span><\/p>

Any Company employee\u2019s relationship with a vendor or contractor that conflicts or could appear to conflict with the Company\u2019s business interests must be avoided. We require our employees to disclose such potential conflicts of interest promptly. We also expect our vendors and contractors to bring any actual, potential, or perceived conflicts of interest to the attention of their Company point of contact.<\/span><\/p>

Privacy and Security<\/span><\/span><\/p>

Vendors and contractors are responsible for ensuring that all personnel who provide services to the Company that involve resident protected health information (PHI) are aware of and familiar with the requirements of both the Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security Rules and, where applicable, state laws that provide more stringent protection of PHI. If a vendor or contractor\u2019s business relationship with the Company will require access to or utilization of PHI, the vendor or contractor will be required to sign a Business Associate Agreement and any other agreements that may be applicable to the relationship.<\/span><\/p>

Product Safety<\/span><\/span><\/p>

All products and equipment delivered by vendors and contractors must meet the quality and safety standards required by applicable law. Vendors and contractors who provide the Company with products or equipment used in resident care must notify the Company of any applicable recalls (including any correction or removals) as required by Food and Drug Administration statutes or regulations.<\/span><\/p>

No Exclusions<\/span><\/span><\/p>

Vendors and contractors are responsible for taking all necessary steps to ensure that they and their personnel are not excluded, debarred, or otherwise ineligible to participate in Medicare or Medicaid or any other Federal health Care Program.\u00a0<\/span><\/p>
